These Terms of Service ("Terms") govern your access to and use of the websites, products, and services provided by GRNDWRK, Inc. ("GRNDWRK," "we," "us," or "our"). By accessing or using our services, you agree to these Terms. If you do not agree, do not use the services.
GRNDWRK provides AI-assisted lead response, follow-up, marketing, reporting, and related growth services for home-services and local businesses. We may add, change, or discontinue features at any time.
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information you provide and for all activity under your account, including keeping your credentials confidential.
If you opt in to receive text messages from GRNDWRK, the following terms apply:
You agree not to use the services to violate any law; to send unlawful, harassing, or unsolicited messages; to infringe the rights of others; or to interfere with the security or integrity of the services. You are responsible for obtaining all required consents from your own customers before using our messaging features to contact them.
Paid plans are billed in advance on a recurring basis, and any one-time setup fees are billed at onboarding. Fees are non-refundable except as required by law or expressly stated. You authorize us to charge your payment method for all applicable fees.
We and our licensors own all rights in the services, including software, content, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the services during your subscription. You retain ownership of your own data and content.
The services integrate with third-party platforms such as CRMs, ad platforms, and messaging providers. Your use of those platforms is governed by their own terms, and we are not responsible for their acts or omissions.
The services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted or error-free, or that they will produce any particular business result.
To the maximum extent permitted by law, GRNDWRK will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total liability for any claim arising out of the services will not exceed the amount you paid us in the three months before the event giving rise to the claim.
You agree to indemnify and hold GRNDWRK harmless from any claims, damages, and expenses arising from your use of the services, your content, or your violation of these Terms or applicable law, including messaging and consent laws.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.
We may update these Terms from time to time. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
